We process sensitive information when reasonably necessary to provide the Service, at your direction, with consent where required, or as otherwise permitted by law.
Where applicable law provides a right to limit certain processing of sensitive personal information, we honor that right as required.
4. HOW WE USE INFORMATION
To the maximum extent permitted by applicable law and consistent with notices and consents provided to you, we may use information to:
- provide the Service;
- establish and maintain accounts;
- conduct AI-assisted interviews;
- generate interview questions;

5. ARTIFICIAL INTELLIGENCE PROCESSING
Artificial intelligence is a core component of the Service.
AI systems may process User Content to perform functions including:
- speech recognition;

Some AI functionality may be supplied by third-party technology providers.
Accordingly, Family Content may be transmitted to or processed through third-party AI systems acting on our behalf to provide the requested Service. This includes running existing models to conduct interviews, transcribe, edit, summarize, and create project materials. It does not authorize a provider to use Family Content to train, fine-tune, or improve its own models, general-purpose models, or models for other customers. Company will require provider arrangements consistent with these restrictions.
6. AI TRAINING AND PRODUCT IMPROVEMENT
Company may use information generated through use of the Service to develop, test, evaluate, secure, and improve EverKnown's internal technologies and systems. This may include testing prompts, evaluating interview or editing quality, measuring transcription accuracy, improving question selection and organization, detecting errors, improving safety, and developing EverKnown functionality.
This is not a promise that no model development or internal improvement will ever occur. Family Content may be used for internal EverKnown development or improvement under Company's control, subject to applicable law, contractual commitments, and any required consent or user choice.
Company will not permit an outside company to use Family Content to train, fine-tune, or improve that company's own models, general-purpose models, or models for other customers. Necessary processing by providers on EverKnown's behalf is allowed only within the purposes and restrictions described in this Policy.
Company will not sell Family Content, license it for independent use, or commercialize it as a content or data product. This restriction includes Family Content-derived information even after aggregation, anonymization, or de-identification. It does not prevent charging for the requested EverKnown Service, sharing at your direction, or the separate explicit promotional authorization described in Section 10. Promotional authorization does not authorize outside-company model training or sale of Family Content.
Where applicable law requires consent or provides a right to opt out of particular processing, Company will obtain consent or provide the required mechanism.
7. DERIVED AND DE-IDENTIFIED INFORMATION
We may derive information from User Content and Service activity, including metadata, statistics, embeddings, classifications, topic labels, technical measurements, model evaluations, performance data, usage patterns, and quality measurements.
Information derived from Family Content remains subject to the Family Content protections in Sections 5 and 6. Aggregating, anonymizing, or de-identifying it does not create permission for outside-company model training, independent licensing, sale, or commercialization as a content or data product.
For information derived solely from technical website or Service usage activity that is not Family Content, we may use, retain, disclose, license, commercialize, or otherwise process lawfully aggregated or de-identified information for lawful business purposes, subject to applicable law and the other notices and choices in this Policy.
We may maintain de-identified information in de-identified form and may take reasonable measures designed to prevent re-identification where required by law. Retention does not remove the restrictions applicable to Family Content.
8. WHEN WE DISCLOSE INFORMATION
We may disclose information to the following categories of recipients.
A. Service Providers and Contractors
We may provide information to companies that assist us with:
- cloud hosting;
- data storage;
- content delivery;
- artificial intelligence;
- transcription;
- video processing;
- image processing;
- audio processing;
- editing;
- payment processing;
- customer support;
- analytics;
- communications;
- email delivery;
- cybersecurity;
- fraud detection;
- legal compliance; and
- other business functions.
B. Project Owners and Collaborators
Information submitted to a family project may be available to the project's account holder, storyteller, invited family members, collaborators, or other authorized participants.
The scope of access depends on project permissions and functionality.
C. At Your Direction
We may disclose information when you:
- share a project;
- send a viewing link;
- invite another person;
- publish material;
- download and distribute an Output;
- connect another service; or
- otherwise instruct us to disclose information.
D. Professional Advisers
We may disclose information to lawyers, accountants, insurers, auditors, consultants, financial advisers, and other professional advisers.
E. Corporate Transactions
Information may be transferred or disclosed in connection with:
- financing;
- investment;
- merger;
- acquisition;
- asset sale;
- bankruptcy;
- restructuring;
- reorganization;
- due diligence; or
- transfer of all or part of our business. Family Content transferred in such a transaction remains subject to the Family Content protections in this Policy; the transaction does not authorize independent model training or sale of Family Content as a content or data product.
F. Legal and Safety Purposes
We may disclose information where we reasonably believe disclosure is necessary or appropriate to:
- comply with law;
- respond to subpoenas or legal process;
- respond to law-enforcement requests;
- protect legal rights;
- investigate fraud;
- enforce agreements;
- protect users;
- protect Company;
- protect physical safety; or
- address security incidents.
G. Advertising and Analytics Partners
Subject to applicable law, we may use analytics and advertising technologies that disclose certain identifiers, internet activity, device information, or marketing information to advertising, measurement, or analytics partners.
Where such activity constitutes a "sale," "sharing," or "targeted advertising" under applicable privacy law, we provide applicable opt-out rights.
Family Content is not sold as advertising inventory or provided to advertising partners for independent use. Public promotional use of Family Content requires the separate explicit authorization described in Section 10.
9. SALE AND SHARING OF PERSONAL INFORMATION
Privacy laws use terms such as "sale" and "sharing" more broadly than ordinary commercial usage.
For example, certain transfers of online identifiers to advertising partners may legally constitute a sale or sharing even where no money is paid for the information.
Where required by applicable law, you may opt out of:
- sale of personal information;
- sharing for cross-context behavioral advertising; and
- processing for targeted advertising.
Requests to opt out of sale, sharing, or targeted advertising may be submitted to admin@everknown.co. State the privacy choice you want to exercise. Stephen Oliver monitors this inbox.
Where required, we recognize qualifying browser-based opt-out preference signals, including Global Privacy Control.
Company does not knowingly sell personal information of children in violation of applicable law.
10. PROMOTIONAL USE OF USER CONTENT
Private Family Content is not automatically authorized for public advertising or promotional use by using or purchasing the Service, accepting the ordinary Terms, or participating in an interview.
Company may use Family Content in public marketing only with separate explicit authorization identifying the material and the permitted promotional use. A separate promotional release may record that authorization. Sharing within your family or at your direction does not by itself authorize Company marketing.
Promotional authorization does not permit outside-company model training, independent content or dataset licensing, or sale of Family Content. The scope and duration of authorized promotional use are governed by the separate authorization and applicable law.
11. TESTIMONIALS AND REVIEWS
Independent reviews that customers post about Company remain subject to applicable consumer-review laws.
We do not claim ownership of independent consumer reviews merely because the reviewer is a customer.
If a person separately authorizes Company to use a testimonial, interview, case study, or promotional recording, Company may use that material in accordance with the applicable promotional release.
Where required, Company may disclose incentives, compensation, relationships, or other material connections associated with testimonials.
12. CHILDREN
The Service is intended for use by adults.
Children under 13 may not independently establish accounts or directly submit personal information to Company without legally sufficient parental or guardian authorization.
Family projects may nevertheless include photographs, videos, recordings, stories, or other information concerning children.
Where Company knowingly collects personal information directly from a child in circumstances governed by the Children's Online Privacy Protection Act or another applicable child-privacy law, Company will obtain verifiable parental consent where required.
Where separate parental consent is legally required for disclosure to third parties, targeted advertising, or another purpose, Company will obtain such consent.
We do not knowingly use children's personal information for targeted advertising in violation of applicable law.
Information concerning children will be retained only for as long as reasonably necessary for the purpose for which it was collected or as otherwise permitted by law.
Parents or guardians may contact admin@everknown.co regarding information concerning a child.
13. BIOMETRIC INFORMATION AND VOICE INFORMATION
Ordinary photographs, videos, and voice recordings are not necessarily regulated biometric identifiers merely because they depict a face or contain a voice.
However, certain technology may generate or process information such as:
- voiceprints;
- scans of face geometry;
- fingerprints;
- iris or retina scans; or
- other biometric identifiers.
If Company offers functionality that collects or creates regulated biometric identifiers or biometric information, Company will provide any notice and obtain any consent required by applicable law.
Where required, the notice will identify:
- the biometric information being collected;
- the purpose of collection;
- how the information will be used;
- how long the information will be retained; and
- the categories of recipients to whom it may be disclosed.
Company will not sell, lease, trade, or otherwise profit from regulated biometric identifiers where prohibited by law.
14. BIOMETRIC RETENTION AND DESTRUCTION POLICY
Where Company possesses information governed by a biometric privacy law requiring a public retention policy, Company follows the following policy unless a shorter period is required.
Regulated biometric identifiers and biometric information will be retained only for the period reasonably necessary to accomplish the specific purpose for which they were collected.
For information subject to the Illinois Biometric Information Privacy Act, Company intends to permanently destroy such information when the initial purpose for collecting or obtaining it has been satisfied or within three years of the individual's last interaction with Company, whichever occurs first, unless retention is otherwise permitted or required by applicable law.
Company may instruct applicable service providers to delete such information in accordance with contractual and legal requirements.
15. HEALTH AND MEDICAL INFORMATION
Family interviews may include discussion of health, medical conditions, diagnoses, disabilities, family medical history, or other health-related information.
Company is not a healthcare provider merely because such information is processed through the Service.
Unless Company has expressly entered into a Business Associate Agreement or other agreement establishing different obligations, the Service should not be assumed to be a HIPAA-covered medical-record service.
Users should not use the Service as their sole repository for medical records.
16. INFORMATION CONCERNING DECEASED PEOPLE
Family-history projects frequently concern deceased individuals.
Privacy and publicity rights concerning deceased persons vary by jurisdiction.
We may process information concerning deceased individuals where provided by users.
The person providing material concerning a deceased person is responsible for obtaining estate, copyright, publicity, or other authorization where legally required.
17. DATA RETENTION
We retain information for periods reasonably necessary for:
- providing the Service;
- maintaining projects;
- completing transactions;
- processing payments;
- allowing downloads;
- maintaining account history;
- resolving disputes;
- providing customer service;
- preventing fraud;
- protecting security;
- complying with law;
- enforcing agreements;
- establishing or defending legal claims; and
- conducting legitimate business operations.
Retention periods may vary depending on the type of information.
User Content may be retained while an account or project remains active and for a commercially reasonable period afterward.
Following deletion, information may remain temporarily in:
- backups;
- disaster-recovery systems;
- security records;
- fraud-prevention systems;
- logs;
- legal archives; or
- systems maintained by service providers.
Such copies may be inaccessible in the ordinary course of business and deleted according to applicable retention schedules.
De-identified information may be retained indefinitely where permitted by law. Any retained information that is Family Content remains subject to the restrictions on outside-company model training, independent licensing, sale, and commercialization described in Sections 5 through 7.
18. USER DELETION REQUESTS
Users may request deletion of eligible information through admin@everknown.co or by emailing admin@everknown.co.
Deletion rights are subject to applicable legal exceptions.
We may retain information where reasonably necessary to:
- complete transactions;
- provide requested services;
- protect security;
- prevent fraud;
- exercise legal rights;
- comply with law;
- maintain financial records;
- resolve disputes;
- enforce agreements; or
- satisfy another permitted exception.
Deleting a project from active Service functionality may not immediately eliminate every backup copy.
19. SECURITY
We use administrative, organizational, physical, and technical safeguards designed to protect information.
No system can guarantee absolute security.
Accordingly, Company cannot guarantee that:
- information will never be accessed without authorization;
- encryption will never be compromised;
- service providers will never experience a security incident;
- data will never be lost; or
- malicious actors will never circumvent security controls.
Users are responsible for safeguarding their own credentials and devices.
20. YOUR RESPONSIBILITY FOR SHARING
Once an Output, video, photograph, transcript, or other material is downloaded, shared, sent, published, copied, or otherwise disclosed by a user, Company may no longer be able to control that information.
Users should carefully consider:
- who receives project links;
- who is invited to collaborate;
- whether recipients may download content;
- whether material should be posted publicly; and
- whether sensitive family information should be distributed.
Company is not responsible for redistribution by persons to whom a user has voluntarily provided access.

- interview invitations;
- family questions;
- security;
- service changes;
- billing; and
- customer support.
Where permitted, we may also send promotional communications.
Users may unsubscribe from promotional email using the unsubscribe mechanism provided in the communication.
Transactional communications may continue while necessary to administer an account or transaction.
EverKnown text notifications
If you choose EverKnown text notifications, we use your verified phone number, your separate notification choices, consent records, and message delivery and opt-out records to provide and operate the notifications you requested. These notifications cover your scheduled conversations and Stories shared with you that you are authorized to access. Verifying a phone number for account sign-in does not enroll you in these notifications.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
We may disclose information necessary to deliver and operate these notifications to messaging service providers, including Twilio, and telecommunications carriers acting to provide the service. You can withdraw your notification choices in Account → Notifications, or reply STOP to stop texts to that number. For help, reply HELP or contact admin@everknown.co.
